Terms of Service – Aham (up.aham.ro)

Last updated: October 18, 2026

Romanian version (prevailing): Termeni și condiții.

1. Who we are and what these Terms cover

Aham (the "Service") is a community website at up.aham.ro where members share links, ask questions, present their own projects, comment, vote and save posts. The Service is operated by Cosmin Albulescu, an individual in Romania acting in a personal capacity (not a company), reachable at admin@aham.ro ("we", "us").

By accessing or using the Service you agree to these Terms of Service (the "Terms"). If you do not agree, please do not use the Service. These Terms should be read together with our Community Guidelines, FAQ and Privacy Policy.

2. Eligibility

You must be at least 16 years old to create an account (or the minimum age of digital consent in your country, if higher). If you use the Service on behalf of an organization, you confirm that you are authorized to bind it to these Terms.

3. Accounts and sign-in

  • You can browse public content without an account. Posting, commenting, voting, hiding and saving require signing in.
  • Sign-in is handled by the Aham identity service at id.aham.ro (using OpenID Connect and OAuth 2.0), which has its own Terms and Conditions (https://aham.ro/en/terms) and Privacy Policy (https://aham.ro/en/privacy); by signing in you also agree to them. We store an account identifier and profile details (for example, your display name and username) needed to run the Service.
  • You are responsible for activity under your account and for keeping your sign-in credentials secure. Tell us promptly if you suspect unauthorized use.
  • Provide accurate information. Do not impersonate another person or organization, and do not operate multiple accounts to manipulate votes or evade a restriction.

4. Your content

Ownership. You keep ownership of the content you submit, including titles, descriptions, comments and questions ("User Content"). Linked third-party material remains the property of its owners.

Licence to us. To run the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, format, translate for display, and distribute your User Content within and in connection with the Service (including search results, previews, and social sharing cards). This licence ends when your content is removed from the Service, except for copies in backups for a reasonable period and content that others have quoted or replied to in the normal course of discussion.

Your promises. You confirm that you have the right to submit your User Content, that it does not infringe anyone's rights, and that it complies with these Terms and the law.

Shared links. Link to the original source and use your own words. For third-party news articles, keep descriptions brief (no more than 40 words); do not reproduce detailed summaries, article structure, examples, or distinctive phrasing. Do not copy substantial parts of third-party articles into the Service.

5. Community rules and prohibited conduct

You agree to follow the Community Guidelines: share the original source, use clear and accurate titles, vote on the basis of usefulness, and use downvotes sparingly. In addition, you must not:

  • post unlawful content, including content that is defamatory, hateful, violent, sexually exploitative, or that incites crime or discrimination;
  • post spam, deceptive or misleading content, scams, phishing links, or links to malware;
  • harass, threaten, dox, or target other members;
  • infringe intellectual property, privacy or other rights of anyone;
  • manipulate voting, karma or rankings (for example, vote rings, bots, purchased votes, or self-promotion through fake accounts);
  • scrape, crawl or harvest data at scale, or overload or interfere with the Service, except as allowed by our robots directives or written permission;
  • probe, test, or circumvent security or access controls, or use the Service to attack others;
  • use the Service to train AI models on member content without our written permission.

6. Voting, karma and rankings

Posts and comments are ranked by community votes. Karma is a number reflecting votes received on your posts and comments; it has no monetary value and gives no right to any benefit. We may adjust, hide, or reset scores and rankings where we detect manipulation or abuse.

7. Moderation and enforcement

We may, at our discretion and in line with applicable law, remove or restrict content, limit features, suspend or terminate accounts, or take other proportionate measures when we reasonably believe these Terms, the Community Guidelines or the law have been breached, or to protect the Service and its members. Where required by law, we will tell you what action we took and why, and explain how to contest it. You can ask us to review a decision by writing to admin@aham.ro.

8. Reporting illegal content (notice and action)

If you believe content on the Service is illegal or infringes your rights, send a notice to admin@aham.ro with: (a) the exact URL(s); (b) an explanation of why you consider the content illegal or infringing; (c) your name and email address (unless the notice concerns child sexual abuse material or similar offences where this is not required); and (d) a statement that you are acting in good faith and that the information is accurate and complete. We will review notices diligently and act as required by law, including Regulation (EU) 2022/2065 (Digital Services Act). Our point of contact for authorities and for users of the Service is admin@aham.ro.

Copyright holders: please include proof of ownership or authorization and the specific work allegedly infringed.

9. Third-party links, services and advertising

The Service links to websites and resources that we do not own or control. We are not responsible for their content, availability, accuracy, security or practices, and a link is not an endorsement. The Service may display advertising or sponsored placements, which will be labelled. Your dealings with advertisers or third parties are solely between you and them.

10. Privacy and cookies

We process personal data as described in our Privacy Policy. We use a session cookie for sign-in and cookies for preferences such as language, theme and accent colour. Optional analytics and advertising services load only where your cookie preferences permit; you can change your choice at any time via "Cookie settings" in the footer.

11. Intellectual property in the Service

The Service itself (software, design, name, logos, and compilation of content, excluding User Content) is owned by us or our licensors and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose under these Terms. All rights not expressly granted are reserved. "Aham" and related logos may not be used without our permission.

12. Availability and changes to the Service

We work to keep the Service available, but it is provided on an ongoing basis and may be interrupted for maintenance, updates or reasons beyond our control. We may add, change or discontinue features, and we may stop operating the Service, giving reasonable notice where practicable.

13. Disclaimers

To the fullest extent permitted by law, the Service and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. User Content and linked content express the views of their authors, not ours, and we do not guarantee their accuracy, legality or quality. Nothing on the Service is professional, legal, medical or financial advice.

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of profits, data, goodwill or business opportunities arising from your use of the Service. Our total liability for any claim relating to the Service is limited to EUR 100 (or the amount you paid us in the 12 months before the claim, if any, if greater). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law, including liability for intent or gross negligence, for death or personal injury, or any mandatory consumer rights you hold.

15. Indemnity (business users only)

If you use the Service for business or commercial purposes, you agree to indemnify us against third-party claims arising from your User Content or your breach of these Terms. This clause does not apply to consumers.

16. Termination and account deletion

You may stop using the Service and delete your account at any time by using the account deletion feature in your Aham identity account settings (id.aham.ro) or by contacting admin@aham.ro. Deleting your Aham identity account also removes your sign-in to other connected applications. We may suspend or terminate your access under Section 7. Sections that by their nature should survive termination (including 4, 11, 13, 14, 17 and 18) will continue to apply. Public posts and comments may be removed or anonymized on account deletion, as described in the Privacy Policy.

17. Governing law and disputes

These Terms are governed by Romanian law, without affecting mandatory consumer protections of your country of residence in the EU. Courts of Reșița, Romania, have jurisdiction, unless mandatory law gives you the right to bring a claim in the courts of your place of residence. Consumers may also use out-of-court dispute resolution: ANPC (anpc.ro) and the EU Online Dispute Resolution platform where available. We encourage you to contact us first at admin@aham.ro so we can try to resolve the issue.

18. General

  • Changes. We may update these Terms. For material changes we will give at least 30 days' notice on the Service or by other reasonable means. Continued use after the effective date means you accept the updated Terms; if you do not, you must stop using the Service.
  • Entire agreement. These Terms, the Community Guidelines and the Privacy Policy are the whole agreement between you and us about the Service.
  • Severability. If a provision is invalid, the rest remains in force.
  • No waiver. Not enforcing a provision does not waive it.
  • Assignment. We may transfer our rights and obligations to a successor; you may not transfer yours without our consent.
  • Language. These Terms may be provided in several languages. If there is a conflict, the Romanian version prevails.
